legal and ethical issues in advertising
Q1: What is the role of OfComm and The Advertising Standards Agency in regulating advertising in the UK? They both regulate the kind of adverts that are showed in the UK are correct. They follow certain rules these are written by the Committee of advertising Practice.
Q2: What are the areas of advertising that are regulated by the ASA?
TV
radio adverts
Billboards
The Web Sometimes
Social Media.
Q3: How does the role of the ASA and OfComm differ in how they monitor advertising? Offcom is more of a punishment organisation while ASA gives out small fines and warnings. E.g Disney sue Netflix the Offcom board would deal with that because of the sizes of the company.
Task:
Research 2 adverts that have been withdrawn by the ASA in the last 3 years, on your blog explain what the advert was for, how it broke the rules and why it was removed from the media.
Philadelphia Advert This was banned because of complaints that men were bad parents. It broke the rules on sexism and was banned soon after its release. The advert was for Philadelphia.
The Volkswagen advert has a problem because it is sterotyping women to do the dishes and make the lunch for the man the man is in space and is driving the cool car past a model. The idea is if buy this car you will have a beautiful wife and amazing adventures.
Ethical Issues
An ethical issue is one which may not break regulation but may still caiuse offence to the audience(s) for another reason (use of certain body shapes, use of children etc. ) or may be morally wrong in its approach to a topic but stays inside ASA guidelines.
Task:
Choose one advert that you feel may have an ethical problem, explain why you feel an ethical issue is present and what effect that may have on the target audience(s).
The match Advert has an ethical issue in that the advert is too sexually explicit and too sexual.
Task:
Explain what YOU will need to consider in terms of legal issues and ethical problems when creating your advertising campaign. How you will avoid breaking any laws and keep the production ethically sound.
Copyright of the sound and getting the rights as well as using the corr
ect type of music e.g not the Russians national anthem.
Legal - anything governed by the government.
Ethical issues - not covered by law which may raise strong feelings or moral question in the audience.
